Convicted extortionist Xavier Andre Justo was deemed a flight risk and denied bail pending appeal on Monday by the Southern Bangkok Criminal Court, according to his lawyer Worasit Wiriyapiboon.
The court on August 17 sentenced the Swiss national to three years in prison for attempted blackmail of his former employer PetroSaudi International (PSI), backdated to his arrest on June 22.
On October 14, Justo's lawyer asked the appellate court to change the sentence to a suspended prison term.
On Monday, his lawyer sought bail for his client pending the outcome of his appeal.
The court denied the request. It said Justo’s prison term had already been reduced by half, on his confession, and if released he might jump bail, Mr Worasit said.
His lawyer also said that Justo’s lawsuit as a plaintiff against three people, including Clare Rewcastle-Brown, the Malaysian-born Britain-based editor of the online Sarawak Report, would go ahead as planned in Singapore.
Justo would be represented by a Singaporean lawyer and the three defendants would appear in the Singapore court on November 4 to hear the charges, Mr Worasit said.
Justo had previously claimed he was offered US$2 million to share confidential data from PetroSaudi with an unidentified Malaysian group, but he was never paid. In his 22-page confession, Justo named the individuals who allegedly offered to buy the information from him.
PetroSaudi is an energy company that was involved in a failed venture with state investment firm 1Malaysia Development Berhad (1MDB) in 2009.
Malaysian media, the Sarawak Report and The Age (sic.) newspaper published reports about alleged misappropriation of funds at 1MDB, whose advisory board is headed by Malaysian Prime Minister Najib Razak.
Justo, 49, a former executive of PetroSaudi International, was arrested on Koh Samui island on June 22 and later convicted of disclosing confidential information from his ex-employer relating to alleged corruption at 1MDB.
Justo quit PetroSaudi International in 2011 and claimed to possess compromising information and wanted US$2.5 million not to reveal it.

Swiss citizen Xavier Andre Justo, who was sentenced to three years jail for blackmailing his former employer, PetroSaudi International, was today denied bail pending the outcome of his appeal against the sentence.
Justo appeared at the Bangkok South Criminal Court for the hearing this morning accompanied by seven correctional officers as well as his Thai lawyer Worasit Piriyawiboon.
He failed to get bail as the court was concerned that he would use the opportunity to escape Thailand.
Worasit told Bernama that he will submit a fresh bail application again next week.
The bail application offering to post a one million baht bail was submitted on October 14 together with an appeal against the three-year sentence that was imposed on him on August 17.

A Swiss man convicted of extortion in a case relating to alleged corruption at a firm chaired by the Malaysian premier, was denied bail by the Southern Bangkok Criminal Court yesterday.
The court said said Xavier A Justo was a flight risk and denied his bail request. The decision came 12 days after Justo filed an appeal over his three-year sentence for attempted blackmail of his former employer PetroSaudi International, his lawyer Worasit Wiriyapiboon said.
"The court argued that Justo's jail term was already reduced by half and if released the defendant might jump bail," Mr Worasit said.
Justo was sentenced on August 17 after pleading guilty to extortion.
Alleged connections between PetroSaudi and state investment firm 1Malaysia Development Berhad (1MDB), which has an advisory board headed by Prime Minister Najib Razak, surfaced in July.
Media outlets including the London-based website Sarawak Report, and Malaysian outlet The Edge, reported that nearly US$700 million (24.8 billion baht) in 1MDB funds were transferred in 2013 to bank accounts allegedly controlled by Mr Najib before the general elections.
Justo, who stole data from PetroSaudi and threatened to sell it, denied any direct involvement in the 1MDB case itself.
Mr Najib has denied any wrongdoing and called the leaking of documents part of a plot against him.
Mr Worasit said Justo is now filing a suit in Singapore against a number of people including Clare Rewcastle Brown, the editor of Sarawak Report and sister-in-law of former British prime minister Gordon Brown.
The defendants in that case are due to appear in a Singaporean court on November 4 to hear the charges, the lawyer said.
Justo previously claimed he was offered US$2 million to share the stolen data with an unidentified Malaysian group, but was never paid.
Sources involved in the investigation of the case said Justo's case in Singapore would show the buyers of the information had tampered with it.
