CURRENT / CLARE BROWN FINALLY FILES HER DEFENCE, INCLUDES A COUNTER-CLAIM AND CONFIRMS HER LAWYERS WERE CHANGED

AFTER a lull, Clare Rewcastle Brown finally managed to file her defence in the case of Hadi Awang v. Clare Brown. For added effect, she even included a counter-claim although suspiciously, she is completely mum about it. 

Certainly a strange change in attitude coming from the 'Mother of all Sensational News' herself - to whom commenting sub judice is a daily thing, in fact an oft-deployed battle tactic.

We are very curious as to the value of the counter-claim that Ms Brown filed, and certainly she should share this information with everyone, if it is so justifiable. 

Interestingly, it seems as if the prospect of simply winning at cost isn't enough for Clare, and she will attempt to fleece as much money as she is able, given the chance - as evidenced in this latest development.

It could also mean that Clare is hoping to deter Hadi from proceeding with the case with the threat of an (presumably huge) undisclosed sum as counter-claimed by Ms Brown.

Or both. Until more information trickles out, you get to decide for now.

Another interesting fact that we can glean from this development is the fact that she in fact did change her "horses mid-stream" as alleged by blogger Raggy Jessy a.k.a. The Third Force previously. There is somehow a silent admission on the fact that she changed her lawyers although she was also atypically mum about that whole question. 

So much for transparency.

Clare Rewcastle Brown has filed her defence in response to PAS president Abdul Hadi Awang’s defamation suit against the editor of the whistleblower website, Sarawak Report. 
She also revealed that a counter-claim had been filed against Hadi. 
The defence and counterclaim were filed in the UK High Court this afternoon,” she told FMT in an e-mail. 
Clare, who did not provide details, said the filing includes a summary of the lengthy full document.
Last week, in updating FMT on the suit, Clare said she would file her defence very soon. 
Meanwhile, lawyer SN Nair said Clare would stand to obtain costs and damages if the court dismissed Hadi’s suit and allowed the counterclaim (fresh suit). 
She would only stand to get costs if Hadi is unable to prove his case.  
Clare has gone another step to file an action against the PAS leader,” he said. 
On August 2, the court rejected Clare’s application to demand that Hadi deposit a higher security to meet the expected costs before the start of his suit. 
The court also ordered her to file her defence by August 30. 
However, Clare was given more time after she appointed a new lawyer.
The Islamist party leader was only ordered to place RM80,000 as security, in the event he lost the case against Clare.
 
The suit, filed at the London High Court in April, was related to an article she wrote in August 2016.

SARAWAK Report editor Clare Rewcastle-Brown has filed her defence in the United Kingdom High Court against PAS president Abdul Hadi Awang’s defamation suit, reports Free Malaysia Today. 
Rewcastle-Brown told the portal that the defence and a counter-claim were filed against Hadi yesterday. 
She, however, did not divulge details of the suit only saying the filing includes a summary of the lengthy full document. 
Hadi sued the London-based journalist over an article which appeared on the whistle-blower site last August alleging that he received RM90 million in bribes from Prime Minister Najib Razak in return for support. 
Lawyer S.N. Nair said Rewcastle-Brown would stand to receive costs and damages if the court dismissed Hadi’s suit and allowed the counter-claim (fresh suit). 
She would only stand to get costs if Hadi is unable to prove his case. 
Clare has gone another step to file an action against the PAS leader,” he was quoted as saying. 
The Malaysian Insight reported that Rewcastle-Brown had asked who was funding Hadi’s suit as such cases are expensive in the UK. 
She said Hadi’s lawyer in the UK has so far refused to reveal details of who was funding the suit. 
Nor have they explained why their client is suing in London and not in KL (Kuala Lumpur), where more than a handful of people have at least heard of Hadi Awang. 
She said in August Hadi should reveal if he or his party is footing the bill, which was estimated at £100,000 (RM600,000).  
She also attempted to make the court force Hadi to pay a deposit as security, should he lose the defamation suit. 
The court decided that Rewcastle-Brown should pay Hadi £15,000 (RM83,700), or two-thirds of the cost of her application, with the quantum of the balance to be assessed by the court in due course. 
The court did not accept her argument that she would not be able to bring a legal suit against Hadi in Malaysia, where the “judiciary, government and the prime minister are corrupted and are complicit with him”. 
Hadi offered to pay a RM80,000 deposit, which the court accepted.

EVIDENCE SURFACES THAT CLARE BROWN AND HUBBY STOLE TAXPAYERS' MONEY
The scandal was deemed by the British House of Commons as a deliberate act of criminal malfeasance on Gordon’s part and an abuse of position by a public official to receive gratification. Ms. Rewcastle took the heat off herself and her husband by gallantly defending Gordon, saying,He definitely needed a cleaner when in London, and it was part of his expenses entitlement”.


The Third Force (TTF) is a propaganda blog, says Clare Rewcastle Brown.
According to the Chief Editor of Sarawak Report, TTF “is not a news portal, but a habitually libellous propaganda blog that shouldn’t have been cited by any newspaper.” Ironically, this lady chose to air her fury via Free Malaysia Today (FMT), a Nelson Fernandez run portal that received RM12 million from John Soh between the years 2009 and 2014.
Even more ironical is the fact that the article was written by a Nawar Firdaws, an FMT columnist who was seen intimately dancing with the DAP’s Zairil Christopher in several photos at a drinking hole in the Hartamas area. Despite repeated claims by bloggers and freelance writers of the illicit love affair, FMT and the DAP remained tight lipped about the whole thing and went so far as to censor reports that even so much as mentioned Zairil’s name for several days.

Now, doesn’t this go a long way to show just how credibly and morally unsound FMT is? And is it just a coincidence that Nawar, having been accused of flirting with someone known to be a Lim Kit Siang apologist and stooge, was Ms. Rewcastle’s choice of a ‘journalist’ to take pot-shots at TTF? 
But then, it is not as if the FMT editorial came as a ‘huge surprise’ to me. 
After all, it takes one fake news portal to know another, which explains just why FMT religiously features claims made by Sarawak Report, including the infamous one where Ms. Rewcastle ‘mocked’ PAS president Dato’ Seri Abdul Hadi Awang for failing to sue her. 
The said article, published by FMT on the 8th of April 2017, quoted the disgraced British journalist as saying that PAS failed to sue her despite threatening to do so. The Sarawak Report chief editor was referring to a letter of demand that Hadi’s United Kingdom (UK) lawyers issued her portal on the 13th of December 2016. 
They threatened to sue me within a week if I didn’t do lots of things in mid-December… but didn’t,” she said. 
But she may have spoken too soon. 
Nineteen days after that cocky and sarcastic jibe, Hadi got his lawyers to file a defamation suit against her and Sarawak Report at a High Court in London. The suit pertained allegations made by Sarawak Report that the Prime Minister of Malaysia, Dato’ Seri Najib Tun Razak, had solicited political favours from Hadi by offering the latter a RM90 million bribe. 
Ideally, the suit should have been the ‘chance of a lifetime’ for Ms. Rewcastle to prove what she had been saying all along, that the Prime Minister of Malaysia was criminally perverse and morally corrupt, enough to offer bribes just to tighten his grip on government. Instead, she failed to offer the London Court even a shred of the “smoking gun evidence” she claimed to possess despite being given months to do so. 
And that’s not all. 
This lady, who “personifies herself to be the defender of truth and justice,” even had the cheek to tell the presiding judge that she ignored past letters sent by Hadi’s lawyers as none of the others she received ended in court battles. She made that bold yet reckless claim during a Case Management hearing on the 6th of August 2017 that was called to decide the amount Hadi needed to deposit with the court as security. 
Now isn’t that tantamount to telling the judge that you’re a habitual delinquent?
And yet, she labelled my portal a “habitually libellous propaganda blog” that the mainstream media should keep a ten-foot pole distance from. Tell me, who is this white piece of trash to dictate terms to the Malaysian mainstream media? How can anyone trust a lady who conspired with her own husband to defraud British taxpayers of their hard-earned money between the years 2004 and 2006

And that, my friends, is not fake news, but the legitimate findings of the British House of Commons as reported by The Telegraph on 8th of May 2009 (screen capture below). The British daily implied that the then Prime Minister of the UK, Gordon Brown, had abused his position in power by “paying his brother” using taxpayer money “for cleaning services at his private flat at Westminter.”

According to the daily, receipts submitted by Gordon to the Parliamentary authorities disclosed that between 2004 and 2006, he paid Andrew £6,577 (worth some £21,000 by today’s standards) over 26 months just to clean his flat!

Whistleblower site Sarawak Report’s editor Clare Rewcastle-Brown is tight-lipped regarding her defence against PAS president Abdul Hadi Awang’s defamation suit against her.
I will not reply in detail at this point, as my lawyers are handling this matter,” she told Malaysiakini today via email when queried on the matter, following reports purporting that she failed to file her defence on time. [The NINE QUESTIONS Panel notes with interest the contradictory nature of this statement of reservation from commenting, which is immediately followed by the comment she supposedly wasn't intending to make. This is typical of the forked nature of any conversations involving Clare Brown.]
On August 31New Straits Times (NST) quoted a blog claiming that Rewcastle-Brown had failed to file her defence by 4pm on August 30 (UK time) and that this is supposedly a violation of an August 2 court order.
The blog reportedly claimed that Rewcastle-Brown’s lawyers would likely file for an extension in October, but the failure would cause alarm to Pakatan Harapan politicians who had demonised Prime Minister Najib Abdul Razak based on her reports.
However, Rewcastle-Brown said the blog post was a “malicious and highly inaccurate” spin and NST should not have republished its claims as though the blog is an accurate or reliable source of information.
She also noted that NST had quoted the blog claiming that US sources had purportedly confirmed that Pakatan Harapan chairperson Dr Mahathir Mohamad had been channelling “millions” into her bank account to topple Najib.
This is an extremely serious, libellous and wholly untrue accusation of the sort that I have become used to from various anonymous and unattributed fringe blogs, but rarely from an authored article in a mainstream newspaper. Frankly, I am shocked,” she said of the allegation. [Better to be at the fringe than to be a fraud. At this point in the article, we wonder why aren't these statements made through Clare Rewcastle Brown's lawyers, just as she said that they will be handling "this matter" - whether that means in terms of making public statements, or the case matter itself. Either way, it is even stranger still why does Clare Brown refuse to confirm - whether through Sarawak Report, her media friends, or even through her lawyers - that her defence was entered within the stipulated time? A simple statement to that effect would dispel and avoid any unnecessary doubt without actually revealing the contents of the defence. But we are seeing nothing of the sort. We are inclined to believe that Raggie Jessy/The Third Force is telling the truth concerning Clare's alleged failure to provide her defence to the court until she or her lawyer can issue an unequivocal confirmation of the timely submission of her defence. Until that happens, she sounds like she is diverting the matter into another conspiracy theory to preoccupy whatever fanbase she may have left so that they will remain loyal to the end, and perhaps not demand that she return the donation money she gleefully fleeced from her supporters knowing full well that she is fraudulent - Clare Rewcastle Brown is welcome to sue us over this statement - if she dares.]
Hadi is suing Rewcastle-Brown over her allegations that he had received RM90 million.

CONCLUSION

Clare Rewcastle Brown knows that she is making this public response out of desperation to convince the public that Sarawak Report truly is telling the truth, when the opposite is true.
As the clock ticks, this erratic and contradictory statement made without going through her lawyers shows that there is a severe disconnect between what she knows she should and shouldn't do, and what she ends up doing - and wrongly at that - out of desperation and panic.

CLARE REWCASTLE'S DONORS ACTUALLY GIVING HADI MONEY
Pakatuns are going to keep enriching Hadi and his lawyers, as Ms. Rewcastle is bent on delaying the trial past the 14th general election (GE14) just to prevent Malaysians from discovering what I have been saying all this while – that all the evidences she claims to possess are nothing short of fabrications wrapped around conjectures and hearsay, none of which are substantiated, none of which hold in the court of law.

Clare Rewcastle Brown has taken you guys for a jolly good ride.
Last Thursday, the disgraced British journalist failed to secure an extension from a London Court in a defamation suit brought against her by PAS president Dato’ Seri Abdul Hadi Awang. The suit pertains allegations that Prime Minister Dato’ Seri Najib Tun Razak solicited political favours from Hadi by bribing the latter RM90 million.
The court’s decision followed Ms. Rewcastle’s repeated failure to file and serve her defense right up to the 30th of August 2017, a deadline stipulated within a court order dated the 2nd of August 2017 (see #2 below). Ironically, this is the same lady who spent close to two years telling Malaysians that she had truckloads of “smoking gun evidences” to prove the Prime Minister of Malaysia was corrupt and criminally perverse.
But the evidence has yet to surface.

Malaysia’s troubled state-investment fund 1Malaysia Development, or 1MDB, said on Wednesday it had paid the second part of a missed instalment to Abu Dhabi’s International Petroleum Investment Company. 
While 1MDB is under pressure and being wound up, the payment could alleviate some concerns about Malaysian state securities for foreign investors, who own a significant share of government bonds in Malaysia. 
Allegations of fraud involving 1MDB, which is under investigation in half a dozen countries, have already spooked investors by weighing on the country’s currency.

Sarawak Report is being sued by PAS, the Islamic Party of Malaysia. We believe we have a strong case and need to stand up to the big money that appears to be flowing into their action.

For the past seven years Sarawak Report has detailed the consequences of politcal (sic) corruption in Malaysia on the environment, civil liberties and the prosperity of the nation.  We have worked on this project as a voluntary not for profit commitment.   
It was our work that exposed what has become the world's largest kleptocracy scandal, involving up to $7 billion dollars stolen from the development fund 1MDB. 
Numerous banks have been already held to account and 15th June the US Dept of Justice issued a third court order for the sequestration of over $1.5 billion in assets bought with money stolen by 1MDB.   
The Prime Minister of Malaysia, Najib Razak, has admitted he used much of this money to buy political support and to win the last election - although he claims that the $681 million that went into his own accounts came from a mystery Saudi Royal donor and not 1MDB as detailed by the joint US, Swiss, Singapore, Abu Dhabi, UK, Hong Kong and Luxembourg investigations into the scandal.Sarawak Report has led on this massive international scandal all the way, revealing story after story both on the crime itself and the distribution of all the proceeds.   
There have been numerous legal threats by various players, but so far none have sued us in the face of overwhelming evidence. [{SR} didn’t {respond to the letters} because the extremely recalcitrant and preponderant Ms. Rewcastle ignored the letters and told the judge that she received dozens of such letters, none of which ended in court battles. Earlier today, she asked the judge to grant her an extension to submit her case against Hadi but it was refused." – The Third Force] However,  Malaysia's Islamic party PAS has now taken exception to being caught up in the scandal, having broken with the opposition alliance in order to collaborate with the Prime Minister's own BN alliance at the very height of the exposures of theft from the development fund. 
Sarawak Report pointed out that the PM distributes money to gain political support and that considerable largesse was noted to have been passing from his administration for the first time into PAS during this very period of intense scandal, at which point a section of the leadership chose to rupture its links with the opposition and later work with Najib instead - splitting the party's own leadership and following in the process. PAS's President Hadi has said he views our comments as a personal attack on his reputation in the UK, yet he is seeking to avoid placing security of costs in the UK court before we file our defence. 
This forces us to pay for expensive legal support to file that defence, money we have little hope of retrieving, whether or not he continues with his case. We believe this is a politically motivated attack and that the people involved are hoping we will settle the action rather than place a defence.  They will then use that outcome, backed by BN's powerful propaganda machine to seek to discredit us.  Please help us fight this case in order to counter this the latest of so many attempts to discredit our work.

The financier of Wolf of Wall Street and others whose assets have been tied up as part of a U.S. government crackdown on foreign corruption are slamming a proposed delay in the 1MDB forfeiture cases.
Earlier this month, federal prosecutors explained the need to pause civil litigation. With claims being made on assets including Hollywood films, a catalogue of EMI songs, a Picasso painting once given to Leonardo DiCaprio, real estate in Beverly Hills, London and New York, and more, the feds sought permission to prioritize their ongoing criminal investigation into an alleged conspiracy to launder money misappropriated from a Malaysian public fund.
Prosecutors wrote that a stay is warranted "because proceeding with civil discovery will have an obvious adverse effect on the related criminal investigation.... Any disclosures by the government beyond those in the complaint will reveal details of the underlying investigation to which the potential targets and subjects are not entitled."

SARAWAK REPORT FAILS TO MEET 4.00 PM DEADLINE
As a result, the Sarawak Report Chief Editor will now have to return to court in October, where it is likely that her counsel will make another attempt to seek an extension. Nonetheless, today’s development is set to trigger an alarm within the Mahathir-led Malaysian opposition coalition that has painstakingly demonised Najib based on her articles.

At 4.00pm United Kingdom (UK) time, Sarawak Report’s Chief Editor, Clare Rewcastle Brown, failed to furnish a London Court with evidence that Malaysian premier Najib Razak bribed PAS president Abdul Hadi Awang RM90 million. Her failure to do so violates a Court Order dated 2nd August 2017 (see below) that required her to file and serve her defence by the stipulated date.
To recap, and in short, Clare is being sued over a Sarawak Report editorial alleging that Najib bribed Hadi RM90 million to solicit political favours from the latter. The PAS president asked his United Kingdom (UK) based lawyers to send her three letters demanding that she apologise for the false allegation but the apology never came.

PAS SATISFIED WITH 1MDB EXPLANATION BY ARUL KANDA
1MDB was thrust into the limelight recently when a US$602.72 million (RM2.58 billion) payment, which was part of its settlement agreement with Abu Dhabi's International Petroleum Investment Company (IPIC), was delayed.

PAS has given the thumbs-up to 1Malaysia Development Bhd (1MDB) chief executive officer Arul Kanda Kandasamy after a meeting with him today.
PAS deputy president Datuk Tuan Ibrahim Tuan Man was reported by online news portals as saying that Arul Kanda’s explanation on the debt incurred by 1MDB and its debt rationalisation plan was “satisfactory.”
Arul Kanda, who was one of the guests at a PAS roundtable discussion on 1MDB held in Ampang, spoke for more than two hours to Tuan Ibrahim and members of the Pas central working committee.
Also present were former Selangor Menteri Besar Tan Sri Khalid Ibrahim, and several academicians from public universities.

In the interest of our readers, we would like to highlight a typical - albeit somehow very popularly visited - blog entry that had certainly put in a lot of thought and effort to keep justifying their continued and undying support for the fraud Clare Rewcastle Brown, and her equally fraudulent Sarawak Report. 

We present it in its translated form, and include the original posting in Malay for verification.

This one example though, truly describes the idiotic dilemma that Clare Brown had expertly put her supporters into this time around. This logic pattern is apparent everywhere even when it's not this obvious - and certainly not this entertaining in its blatant disregard to common sense.

Malaysians are clearly a generous lot. For example, YB Rafizi (PKR-MP for Pandan, Selangor) was able to collect RM1.5 million in 10 days in order to pay a RM300,000 fine following his defeat in the NFC lawsuit.
Taking a leaf from the experience, Pakatan Harapan will organise another fundraising event, this time to help the operator of Sarawak Report Clair Newcastle (sic) Brown, who had been ordered to pay £15,000 to the PAS President, Hadi Awang at a hearing in London.
This is only the starting cost, and Claire (sic) is expected to expend a whole lot more cash to be paid to Hadi, especially in the event that she loses the lawsuit.
Claire (sic) needs to be helped because her exposés have helped Pakatan Harapan to uncover whatever that the government is trying to hide concerning 1MDB. 1MDB-related issues will ensure Pakatan Harapan's victory in the upcoming GE14.
Pakatan Harapan expects to garner RM4 million to help Claire (sic) face the PAS lawsuit. Malaysians who owe her a debt of gratitude must come together and help out.

Last Wednesday, the 2nd of August 2017, a group of British lawyers representing PAS President Dato’ Seri Abdul Hadi Awang attended a Case Management hearing in London. The hearing was to decide the amount Hadi needed to deposit as security with the court in relation to a civil suit he is bringing against Clare Rewcastle Brown, the Chief Editor of Sarawak Report. 
The suit pertains allegations by Sarawak Report that the Prime Minister of Malaysia, Dato’ Seri Najib Tun Razak, bribed the PAS president with RM90 million, money that Ms. Rewcastle claims originated from 1Malaysia Development Berhad (1MDB). To date, she has yet to furnish the court with evidence to substantiate her claims despite being given ample time to do so. 
Yet, she asked the judge to fix £800,000 (about RM4.5 million) as the security Hadi needed to deposit with the court. The PAS president, on the other hand, offered to pay just RM80,000, arguing that the sum was “sufficient and uncontroversial.” Not only did the court accept Hadi’s offer, it ruled that Ms. Rewcastle herself needed to pay costs worth 15,000 pounds (about RM85,000) immediately and the balance upon assessment of the total cost.

The NINE QUESTIONS Panel asks whether Clare Brown will be returning the over £30,000 in 'donations' collected for her legal fees, now determined to be much less than the wild figure of £800,000 she cunningly came up with, perhaps to garner more sympathy for her bogus cause - a conclusion seemingly shared by the courts in London despite CRB's desperately incessant protestations to the contrary. 

Although the possibility that she would be needing a whole lot more than the current amount is tantalisingly within the horizon - and well deserved should the courts find against her. Which should lead the donors to kick themselves in the head for having parted with any sum to defend a person who would then have been proven the liar.

Datuk Seri Abdul Hadi Awang’s case management involving his civil suit against Sarawak Report founder and editor Clare Rewcastle-Brown, favoured on behalf of the PAS president. 
The Case management took place at the Courts in London, United Kingdom on August 2. 
In a statement, Hadi’s political secretary Dr Ahmad Samsuri Mokhtar said the case management arose after Rewcastle-Brown applied to the court for the Marang member of parliament to deposit monies with the court as a security for legal costs involving the parties court proceedings.
