Justo will have his sentence commuted by one-third and will probably serve the remainder of his jail term on parole or be transferred to another prison.

BANGKOK (BERNAMA), August 9, 2016 –  
Swiss national Andre Xavier Justo, who was sentenced to three years’ imprisonment for attempted blackmail of his former employer, PetroSaudi International, has received a royal pardon.

According to lawyer Worrasit Piriyawiboon, his client got the pardon in conjunction with Thailand’s King Bhumibol Adulyadej’s 70 years on the throne and Queen Sirikit’s birthday.

The announcement of the royal pardon was released in a Royal Gazette website last night.

Underneath the strongly-worded, yet sloppy semi-confession and preemptive defence jumps out damaging details and admissions that Clare Rewcastle Brown can no longer deny.

In a surprising development, Sarawak Report is confirmed to have served London-based blogger-in-exile Raja Petra Kamarudin (RPK) a letter of demand through their attorney, Seddons on April 7, 2016.


Contained within the correspondence are basically accusations of erroneous reporting on the part of RPK, demanding - amongst others - for the removal of specific articles that points directly to her murky, hidden past.


1. WHAT "DAMAGING MATERIAL" IS CLARE REWCASTLE TRYING TO KEEP BURIED?

"At the foot of the Malaysia Today article you have provided a hyperlink labelled "READ MORE HERE", inviting readers to click on the link and thereby visit and read what appears at http://www.opensourceinvestigations.com/malaysia/a-record-of-untrue-stories-the-case-of-clare-rewcastle/, a page on a website operated in the name Open Source Investigations ("the OSI article") ... As has obviously been your intention, by so doing you will have caused and will continue to cause readers of the Malaysia Today article also to visit and read the OSI article." – Seddons


Also, the letter continues, "The Articles assert that Ms Rewcastle Brown was a dishonest journalist who was not able to get a job at the BBC or ITV as she was known to publish stories that were known by her to be untrue ... It is your allegation that is deliberately untrue, designed as it is to undermine the corruption that our client has exposed and which you seek to hide. Ms Rewcastle Brown has never run a story that she knew to be untrue."


The article in question (see #6 below) actually features a short, but highly damaging report by the reputable Private Eye Magazine, in its 958th issue of September 4, 1998.

KUALA LUMPUR, April 12, 2016–
 
Details of secret dealings between convicted extortioner Javier Andre Justo and Edge media group owner Tong Kooi Ong may surface if an on-going civil action goes to trial in Singapore, reports Singapore’s Straits Times, with a pre-trial conference slated to be held later this week. 
According to the report, Swiss national, Justo, 48, who was PetroSaudi International (UK)’s IT manager until April 2011, is suing Tong for damages in the island nation’s High Court. 
Justo says that he was owed US$2 million after handing over two data storage drives at Fullerton Hotel to Tong in February last year.

SINGAPORE, April 13, 2016– 
A pre-trial conference between lawyers representing Xavier Andre Justo and Datuk Tong Kooi Ong was held in chambers at the Singapore Supreme Court this morning.

Damodara Hazra LLP appeared for the Swiss national Justo while David Lim & Partners LLP represented Tong, owner of The Edge Media Group, at the conference before

Assistant Registrar Ho Yee Tien Delphine.

Suresh Damodara, lawyer for the 48-year-old former employee of PetroSaudi International, and Tong's counsel Doris Chia declined to comment.

Justo is suing Tong and Group Chief Executive Officer and Publisher of The Edge Ho Kay Tat and founder-editor of the Sarawak Report Clare Rewcastle Brown for damages.

Ho and Rewcastle Brown were unrepresented.

Details of the alleged deal behind the leaks that spawned claims about the misappropriation of billions at a Malaysian state investment firm linked to Malaysian Prime Minister Najib Razak may well unravel in the High Court in Singapore.

Swiss national Xavier Andre Justo, the man allegedly behind the leaks, is suing the owner of Malaysia's The Edge media group Tong Kooi Ong and two others for damages.

Justo claims that he handed over two data storage drives in Mr Tong's presence at a Fullerton Hotel meeting in February last year in return for US$2 million (S$2.7 million) - money which he never received. 
He wants the items - which contain data about global oil services firm PetroSaudi and its business partner 1Malaysia Development Berhad (1MDB) - to be returned and for any copies to be destroyed, according to court documents filed last November.

Malaysian police’s plan to record Swiss national Xavier Andre Justo’s statement in connection with 1Malaysia Development Berhad (1MDB) proceeded today as scheduled in Bangkok, Thailand. 
Inspector-General of Police Tan Sri Khalid Abu Bakar confirmed this to Bernama when asked about the move to record the statement of the PetroSaudi former employer who is currently being detained in Bangkok.

"Our counterparts in Bangkok have given the approval for us to interview Justo," said Amar when contacted. 
Justo, who is a Swiss national, was sentenced to three years jail on August 17 after pleading guilty to blackmailing his former employer PetroSaudi International.

The Malaysian Anti-Corruption Commission (MACC) today confirmed that it has sent a team to the Middle East to meet the donor of the RM2.6bil political fund.

MACC investigations division director Datuk Azam Baki said the meeting with the donor was held recently.

However, Azam could not disclose any details, including the identity of the donor, as investigations were ongoing.

"Investigations into the case are still ongoing. Once we have completed our investigation, we will hand over the findings to the Deputy Public Prosecutor, who will decide on the next course of action.

Ramesh Rao Krishnan Naidu claims that he has seen the “untampered” documents relating to 1Malaysia Development Berhad (1MDB).

The Pertubuhan Minda dan Sosial Prihatin Malaysia president said he was granted access to the documents through former PetroSaudi International executive Xavier Andre Justo’s lawyer, Worrasit Piriyawiboon.

We are not making this up. We have seen the original documents and the tampered ones as published (in several reports),” he said here, Saturday.

Ramesh said the alleged tampering involved dates, names, figures and houses, among others. He, however, stressed that he could not reveal more details as the documents were part of Justo lawyer’s appeal affidavit.

Ramesh said he was shown the documents during a three-day visit to Bangkok, Thailand with his lawyer Zakwan Hafiz Ahmad Ansari on Tuesday.

The trip, he said, was their own initiative to “assist the Malaysian police in their investigation

On October 23, Inspector-General of Police Tan Sri Khalid Abu Bakar said he would send his officers to Bangkok to interview Justo after permission was granted to them following a meeting between Malaysian and Thai police.

Ramesh, however, said he had yet to hear of any development from the police.

That’s why we took these initiatives to meet Justo’s lawyer so it would be easier for the police to conduct their investigation,” he said.

Based on the meeting with Worrasit, Ramesh said he was told that Justo was “100% willing” to meet with Malaysian police.

Ramesh said he felt compelled to pursue the matter as he was the one who lodged a police report for journalist Lester Melanyi over alleged fact-tampering by the Sarawak Report news portal.

The police report also claimed that Lester was reportedly used by Clare Rewcastle-Brown, who runs Sarawak Report and Radio Free Sarawak, to spread false news on the website to purportedly smear Prime Minister Datuk Seri Najib Tun Razak's “good name”.

I am hoping that the police would continue their investigations on Justo and Clare.

I would also like to challenge those who believed anything that was published on Sarawak Report as authentic to make a public apology,” Ramesh said.

On October 14, Justo appealed against a three-year prison term handed down by the Bangkok South Criminal Court on August 17 for blackmailing his former employer, PetroSaudi International.

Among the reasons for the appeal was that Justo did not tamper with the documents he obtained from PetroSaudi International and that it was his first offence.

His lawyer had said that any damage to the image of the Prime Minister was because of the activities of third parties who doctored or tampered with the documents that they received from Justo.

He maintained that Justo had not tampered with the documents.

Convicted extortionist Xavier Andre Justo was deemed a flight risk and denied bail pending appeal on Monday by the Southern Bangkok Criminal Court, according to his lawyer Worasit Wiriyapiboon.

The court on August 17 sentenced the Swiss national to three years in prison for attempted blackmail of his former employer PetroSaudi International (PSI), backdated to his arrest on June 22.

Swiss national Xavier Andre Justo has appealed against the three-year prison term handed down to him by the Bangkok South Criminal Court on August 17 for blackmailing his former employer, PetroSaudi International. 
Justo’s new lawyer, Worrasit Piriyawiboon, filed the appeal in the court yesterday morning with 59 pages of supporting documents, just two days before the period to appeal expires. 
Among the reasons for the appeal was that Justo did not tamper with the documents he obtained from PetroSaudi and it was his first offence. 
This raises a question: If Justo did not tamper with the documents, then who did? Was it Sarawak Report editor Clare Rewcastle Brown or others?

It is a three-month long thread between Justo, Clare Rewcastle-Brown, who was acting as his broker, as well as The Edge Media Group's top guns, Datuk Tong Kooi Ong and Ho Kay Tat.

Petaling Jaya Utara member of parliament and Public Accounts Comittee member Tony Pua, while not a part of "Meet", was widely mentioned, especially by Rewcastle-Brown and Justo.

I fully admit my criminal behaviour and accept my guilt in these matters. I just want to set the record straight and apologise to those who I have wronged. I have conspired with others and further admit offenses of theft of data, handling stolen goods, selling stolen data and IT equipment to third parties and attempting to launder the proceeds of sale. My only motivation for selling the data that I stole was for monetary gain and I never considered myself a whistle-blower.

The three-year jail sentence against Xavier Andre Justo, a heavily tattooed Swiss IT expert, for corporate blackmail by a Thailand criminal court could spark criminal probes and lawsuits in Malaysia, Singapore and the United Kingdom. 
Justo pleaded guilty to the theft of huge amounts of corporate data from his former employer PetroSaudi International, information that became the source of an international media campaign against the Malaysian government over allegations of financial wrongdoings at 1Malaysia Development Berhad, a state-owned investment fund. 
Lawyers and police sources in Bangkok and Kuala Lumpur contend that the admission of guilt by the former PetroSaudi employee could expose those involved to numerous potential offences, including bribery, fraud, cyber security and computer crimes and money laundering. 
The principal players so far identified in the Justo saga are Clare Rewcastle-Brown, founder of the London-based website Sarawak Report, and Tong Kooi Ong, the owner of Malaysia's The Edge Media Group. 
However, investigations by the Thai police revealed that several other influential political and business figures played key roles in the campaign to undermine the Malaysian government led by Datuk Seri Najib Tun Razak. 
Police sources and lawyers also said that Justo's confessions to the Thai police and evidence seized from his home in Thailand's Koh Samui resort town could prove crucial in the ongoing investigations in Malaysia and trigger other actions in Singapore and the United Kingdom. 
The Malaysian government has suspended publication of The Edge and blocked access to Sarawak Report.

Police are also investigating Brown, Tong and the CEO of The Edge, Ho Kay Tat, over allegations that the three personalities are part of a conspiracy to subvert democracy in Malaysia.

Lawyers and police sources said that Brown and Tong might have breached the Bribery Act in the UK as they are alleged to have conspired to bribe and induce Justo to sell stolen corporate data. They may have also breached the UK's Fraud Act by allegedly knowingly acquiring stolen corporate data.

Lawyers and police sources said Tong, Ho and Brown may have also broken laws under Singapore's Computer Misuse and Cybersecurity Act and the island state's penal code for allegedly dealing in stolen property and for allegedly aiding and abetting a conspiracy.

Their actions may have also allegedly breached the Computer Crimes Act in Malaysia, while in Thailand, Brown, Tong and Ho could be charged with allegedly dealing with stolen property, lawyers and police sources said.
